1. Acceptance of Terms

By accessing or using My Compliance Tracker (“Service”), operated by My Compliance Tracker (“we,” “us,” or “our”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

My Compliance Tracker is a Software-as-a-Service (SaaS) platform that helps Certified Public Accountants (CPAs) track Continuing Professional Education (CPE) credits, manage compliance with state licensing requirements, and store CPE certificates. The Service is available at www.mycompliancetracker.com.

The Service is intended solely for professional compliance tracking purposes. It does not constitute legal, accounting, or regulatory advice. You are solely responsible for verifying your compliance obligations with the applicable state board(s).

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. By registering, you represent that all information you provide is accurate and that you have the authority to agree to these Terms.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at our contact page. We are not liable for any loss resulting from unauthorized use of your account.

5. Subscription and Payment

  • Free Trial: New accounts receive a 7-day free trial with full access to the Service. No payment is required to start the trial.
  • Subscription: After the trial period, continued access requires an active paid subscription. Current pricing is displayed on our home page.
  • Billing: Subscriptions are billed annually. All payments are processed securely through Stripe. By subscribing, you authorize us to charge the payment method on file for the applicable subscription fee.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time unless required by applicable law.
  • Price Changes: We reserve the right to change subscription pricing. We will provide at least 30 days’ advance notice of any price change via email or in-app notification.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulation.
  • Upload or transmit malicious code, viruses, or any software that could harm the Service or other users.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.
  • Scrape, crawl, or systematically extract data from the Service without our written consent.
  • Share your account credentials with others or allow multiple users to access the Service through a single account.
  • Misrepresent your identity or impersonate any person or entity.

7. User Data and Privacy

We collect and process personal information in accordance with our Privacy Policy. By using the Service, you consent to such processing. You retain ownership of all CPE certificates and data you upload to the Service. You grant us a limited license to store, process, and display your data solely to provide the Service to you.

We implement industry-standard security measures to protect your data. However, no transmission over the internet is completely secure, and we cannot guarantee absolute security.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and user interface design — are owned by My Compliance Tracker and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

The Service is a tracking tool only. We make no representations regarding the accuracy or completeness of CPE requirement data for any particular state board. Always verify your compliance obligations directly with the relevant licensing authority.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY COMPLIANCE TRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless My Compliance Tracker and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service immediately ceases. You may export your certificate data before termination; after account deletion, we may delete your data in accordance with our data retention policy.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice within the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.
